Please read these Terms and Conditions ("Terms") carefully. By accessing or using the
OnClickSeva platform (the "Service"), you agree to be bound by these Terms and our
Privacy Policy.
1. The OnClickSeva Platform
OnClickSeva is a technology platform that connects users ("You") with independent
third-party service providers ("Professionals"). YOU ACKNOWLEDGE THAT ONCLICKSEVA DOES
NOT PROVIDE HOME SERVICES OR FUNCTION AS A HOME SERVICE PROVIDER. OUR SERVICE IS TO
FACILITATE YOUR CONNECTION TO PROFESSIONALS. WE ARE NOT AN EMPLOYER OF ANY PROFESSIONAL.
2. User Obligations and Prohibited Conduct
As a user, you agree to:
- Provide accurate and complete information during registration and booking.
- Treat Professionals with respect and courtesy.
- Ensure a safe and appropriate environment for Professionals to perform their work.
- Not use the Service for any unlawful purpose, including but not limited to
requesting services for illegal activities, harassment, or fraudulent purposes.
3. Background Checks and Vetting Disclaimer
OnClickSeva may perform a background check on Professionals, which may include identity
verification and criminal record checks. However, we do not guarantee the accuracy,
completeness, or currency of such checks. We are not responsible for any false or
misleading statements made by Professionals. You agree that OnClickSeva is not liable
for the actions, misconduct, or criminal acts of any Professional.
4. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ONCLICKSEVA SHALL NOT BE LIABLE FOR
INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING
LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION
WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES.
ONCLICKSEVA SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY, OR LOSSES ARISING OUT OF:
- Your use of or reliance on the Services or your inability to access or use the
Services.
- Any transaction or relationship between you and any Professional, even if we have
been advised of the possibility of such damages.
- The conduct, actions, or inactions of any Professional. This includes, but is not
limited to, theft, assault, or any other criminal act.
IN NO EVENT SHALL ONCLICKSEVA'S TOTAL LIABILITY TO YOU IN CONNECTION WITH THE SERVICES
FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE TOTAL AMOUNT PAID BY YOU FOR
THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
5. Indemnification
You agree to indemnify and hold OnClickSeva and its affiliates, officers, directors,
employees, and agents harmless from any and all claims, demands, losses, liabilities,
and expenses (including attorneys' fees) arising out of or in connection with: (i) your
use of the Service; (ii) your breach or violation of any of these Terms; (iii) your
violation of the rights of any third party, including Professionals.
6. Dispute Resolution by Arbitration
You agree that any dispute, claim or controversy arising out of or relating to these
Terms or the breach, termination, enforcement, interpretation or validity thereof or the
use of the Services will be settled by binding arbitration between you and OnClickSeva,
except that each party retains the right to seek injunctive or other equitable relief in
a court of competent jurisdiction. The arbitration will be administered in Patna, Bihar,
in accordance with the Arbitration and Conciliation Act, 1996.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any
legal action or proceeding related to this Service shall be brought exclusively in the
courts of competent jurisdiction in Patna, Bihar.
